Some of the news articles displayed in Axcess News, or any of its City Sites, were published by another news organization that licensed with AXcess News to display that content.

Those news organizations have entered into an agreement with AXcess News to display content they submit. AXcess News discloses the publisher as the "Source" at the bottom of those pages, or in such location as required by that publisher. The authors name is also shown at the top, if provided.

Below is a description of the terms and conditions under which AXcess News displays licensed content.

Hereinafter, licensed news organizations are referred to as "Provider".

The Provider is solely responsible for the accuracy and authenticity of the Content submitted by Provider to AXcess News. Provider represents and warrants to AXcess News, as follows:

1. That Provider has the right and is authorized to submit the Content to AXcess News for distribution, broadcasting and/or display;

2. That the Content is true and accurate;

3. That the Provider is not impersonating any entity or misrepresenting Provider's affiliation with any person or entity;

4. That the distribution, broadcasting and/or display of the Content does not violate the state, federal or common law copyright,   trademark, or service mark rights, any other property rights, privacy rights, intellectual property rights, confidentiality rights or other proprietary or contract rights of any third party;

5. That the Content does not contain any information which is libelous or otherwise illegal;

6. That Provider will not misuse the Services or misappropriate the Content to compete directly or indirectly with AXcess News or to engage in derivative commercial activities without AXcess News's prior written consent; and
That Provider has investigated the desirability of utilizing AXcess News's services and is not relying on any representation, guarantee, or statement other than as set forth in the Terms of Service of Provider's License or in the materials on AXcess News's web site, "axcessnews.com".

Edit Rights - AXcess News reserves the right to edit Content, if or as necessary, in order to make corrections to the Content (e.g. misspellings) or to ensure that the Content adheres to AXcess News's Policies, provided, however, that AXcess News will not make any substantive edits without first obtaining Provider's consent.

Unsuitable Content - AXcess News may reject any Provider Content, or require changes to it, if AXcess News determines, in its sole discretion, that the Content is unsuitable. Unsuitable Content ("Unsuitable Content") may include, but is not limited to, that Content which contains sexually explicit materials, promotes violence or illegal activities or discrimination based on race, sex, religion, nationality, disability, sexual orientation, or age, or otherwise violates the intellectual property rights of any person or entity.

Prices - Under AXcess News License to distribute, broadcast and/or display Content submitted by Provider, Provider has agreed to pay a fixed rate to AXcess News for that Service. Prices for AXcess News Syndicate Service may change from time to time, if charged. The price actually charged for a specific Service will be the price in effect at the time the Service is requested, minus any applicable discounts that may have been accorded Provider under a valid License signed by both Provider and AXcess News.

Under Syndicate Distribution Service terms, Provider will be disclosed in the same manner as those that elect to License Syndicate Services, as outlined in Prices, above, however, those Providers do not pay fixed fees. In effect, under a Syndicate Distribution License, display of Content is reciprical with neither party paying fees.

For a list of Providers currently licensed with AXcess News, please use our Contact Form to request that information. Only news organizations may License with AXcess News. AXcess News has the right to examine a Provider's Content for newsworthiness prior to signing a License with that prospective Provider. The rates charged Providers for distributing, broadcasting and/or displaying Content are fixed, meaning all Providers pay the same rate regardless of the quantity, length or category of Content submitted under their Syndicate Services License with AXcess News. Only news organizations may contract with AXcess News in this manner. To obtain the rate paid by a Syndicate Services Provider, please use our Contact Form to request that information. When requesting information of this nature (rates), please include your name, employer, job title, email address and daytime phone number. AXcess News will obtain consent from its Provider to release that information before responding to any inquiry. Should the Provider inquiry be from a competitor of AXcess News, or our client, that Provider has the sole right to grant or deny AXcess News consent to release that information. Any individual requesting that information that is not an employee, officer, director, shareholder or a related party to a competitor will be granted that consent and provided that information. Legal inquiries are exempt from needing Provider's consent and will be provided that information.

AXcess News primarily publishes, distributes, broadcasts and/or displays business, technology, health, environmental, entertainment, national, world and sports news. Readers should not rely on information contained in any Provider Content displayed as being accurate and complete, nor as a means of making decisions. No Content made accessible through AXcess News should be construed as an offer to buy or sell any securities.

AXcess News is a distributor (and not a publisher) of Content supplied by Providers. Accordingly, AXcess News has no more editorial control over such content than does a public library, bookstore, or newsstand.
